This Privacy Policy explains how Servizio, Inc. ("Servizio," "We," "Us," "Our") collects, uses, shares, and protects information about you when you use the Jovial Gaming platform ("Platform," "Service," "Jovial"). This policy applies to all users of the Platform, including those who access Jovial Gaming through the mobile application.

By creating an account or using the Platform, you acknowledge that you have read and understood this Privacy Policy and consent to the data practices described herein. If you do not agree to this Privacy Policy, you must stop using the Platform immediately.

This Privacy Policy is incorporated by reference into our Terms of Use. Capitalized terms not defined here have the meanings given in the Terms of Use.

1. WHO WE ARE

Jovial Gaming is a competitive gaming coordination and ranking platform owned and operated by Servizio, Inc., a company organized under the laws of the State of New York, United States of America.

2. INFORMATION WE COLLECT

2.1 Information You Provide Directly

When you create an account or use the Platform, you may provide us with the following information:

  • Username and display name
  • Email address
  • Date of birth or age verification information
  • Profile information including any bio or social media links you choose to add
  • Match scores and results you submit through the Platform
  • Screenshots and other media you upload to the Platform
  • Messages, voice submissions, and other communications you send through the Platform
  • Payment information processed through third-party app store platforms (we do not directly store payment card information)
  • Any other information you voluntarily provide when contacting us for support

2.2 Information We Collect Automatically

When you use the Platform, we automatically collect certain information about your device and your use of the Platform:

  • Device identifiers including device ID, advertising ID, and device fingerprint data
  • IP address
  • Operating system and version
  • Mobile network information
  • App version and usage data
  • Log data including access times, pages viewed, and features used
  • Crash reports and performance data
  • Push notification tokens

2.3 Location Information

Jovial Gaming is a region-based platform that requires location information to function. We collect:

  • GPS coordinates when you grant location permissions
  • IP address-based approximate location
  • ZIP code and city information for Comp Ground and Zone assignment

Location data is used to place you in the correct Comp Ground and Zone, maintain the integrity of regional rankings, and support anti-fraud and anti-abuse detection. You may limit location access through your device settings, but doing so may limit or prevent your ability to use certain features of the Platform.

2.4 Competitive and Activity Data

We collect data related to your competitive activity on the Platform including:

  • Match history, win/loss records, and scores
  • Ranking points, division status, and zone placement
  • H-Score and integrity history
  • Badge and achievement history
  • Tournament participation and results
  • Dispute history
  • Activity timestamps and session data

2.5 Information from Third Parties

We may receive information about you from third-party services you connect to or use in conjunction with Jovial Gaming, such as social media accounts linked to your profile. We do not collect gameplay data directly from third-party gaming platforms such as PlayStation Network, Xbox Live, or Nintendo Network.

3. HOW WE USE YOUR INFORMATION

We use the information we collect for the following purposes:

3.1 Platform Operations

  • Creating and managing your account
  • Assigning you to your correct Comp Ground and Zone based on location
  • Recording, verifying, and displaying match results
  • Calculating and updating rankings, divisions, and competitive standings
  • Awarding badges, achievements, and competitive honors
  • Processing and resolving disputes
  • Delivering push notifications including the Daily Brief
  • Generating AI-powered editorial content including match recaps and zone activity summaries

3.2 Safety, Security, and Integrity

  • Detecting and preventing cheating, fraud, and abuse
  • Identifying multi-account violations through device fingerprinting and IP analysis
  • Maintaining the H-Score integrity system
  • Investigating reported violations and conducting dispute reviews
  • Enforcing our Terms of Use and Community Guidelines

3.3 Communications

  • Sending you important notices about your account or changes to our policies
  • Responding to your support requests and inquiries
  • Delivering platform notifications including match confirmations, ranking updates, and tournament announcements

3.4 Platform Improvement

  • Analyzing usage patterns to improve features and user experience
  • Conducting research and analytics to understand how the Platform is used
  • Testing new features and identifying bugs

3.5 Advertising and Monetization

  • Displaying advertisements through our AdMob integration and third-party advertising partners
  • Measuring advertising effectiveness
  • Providing advertisers with aggregated, non-personally identifiable information about our user base

4. HOW WE SHARE YOUR INFORMATION

4.1 Public Information on the Platform

The following information is visible to other users of the Platform by default:

  • Your username and display name
  • Your Zone and Comp Ground
  • Your ranking, division, and competitive record
  • Your badges, achievements, and tags
  • Match results in which you participated
  • Your position on leaderboards and rankings

You should not share any information through the Platform that you do not want to be publicly visible to other users.

4.2 Service Providers

We share information with trusted third-party service providers who assist us in operating the Platform. These providers are contractually obligated to use your information only for the purposes of providing services to us and in accordance with this Privacy Policy. Service providers include:

  • Cloud hosting and infrastructure providers
  • Analytics providers
  • Push notification services
  • Advertising networks including Google AdMob
  • Customer support tools
  • Payment processing through applicable app stores

4.3 Legal Requirements

We may disclose your information if required to do so by law or in response to valid legal process including subpoenas, court orders, or government requests. We may also disclose information when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

4.4 Business Transfers

If Servizio is involved in a merger, acquisition, sale of assets, or bankruptcy proceeding, your information may be transferred as part of that transaction. We will notify you via email or prominent notice on the Platform of any change in ownership or uses of your information.

4.5 Aggregated and De-Identified Data

We may share aggregated or de-identified information that cannot reasonably be used to identify you with sponsors, partners, and other third parties for business and research purposes.

4.6 We Do Not Sell Your Personal Information

Servizio does not sell your personal information to third parties for their own marketing purposes.

5. CHILDREN'S PRIVACY — COPPA COMPLIANCE

5.1 Users Under 13

Jovial Gaming is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that we have collected personal information from a child under 13 without verifiable parental consent, we will take immediate steps to delete that information and terminate the associated account.

If you are a parent or guardian and believe that your child under 13 has created an account or provided us with personal information, please contact us immediately at support@jovialgaming.com.

5.2 Users Ages 13 Through 17

Users between the ages of 13 and 17 may use the Platform with the knowledge and consent of a parent or legal guardian. We encourage parents and guardians to monitor their children's online activities and to be aware of the information their children may submit through the Platform.

For users under 18, we apply additional protections including:

  • We do not display targeted advertising based on behavioral tracking to users we know to be under 18
  • We limit the personal information displayed publicly on profiles of users under 18
  • We provide parents or guardians the ability to request review or deletion of their child's account by contacting support@jovialgaming.com

6. DATA RETENTION

We retain your personal information for as long as your account is active or as needed to provide you with the Platform's services. Specifically:

  • Account information is retained for the duration of your account and for a reasonable period following account termination to comply with legal obligations and resolve disputes.
  • Match history, rankings, and competitive records that are part of the History Book may be retained indefinitely as part of the Platform's permanent competitive record, but will be de-identified or anonymized following account deletion where technically practicable.
  • Device fingerprint and IP data used for anti-abuse detection is retained for the duration necessary to maintain platform integrity.
  • Communications and support records are retained for up to three years following your last interaction with our support team.
  • Accounts that are permanently terminated for violations of our Terms of Use may have certain records retained for a longer period to prevent re-registration and protect the integrity of the Platform.

Upon account deletion, we will delete or anonymize your personal information within a reasonable period, except where retention is required by law or necessary for legitimate business purposes such as fraud prevention.

7. DATA SECURITY

Servizio takes reasonable and appropriate technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. These measures include:

  • Encryption of data in transit using industry-standard SSL/TLS protocols
  • Secure storage of passwords using industry-standard hashing
  • Access controls limiting employee access to personal information on a need-to-know basis
  • Regular security assessments and monitoring

However, no method of transmission over the internet or method of electronic storage is 100% secure. While we strive to protect your personal information, we cannot guarantee its absolute security. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.

In the event of a data breach that affects your personal information, we will notify you in accordance with applicable law.

8. YOUR RIGHTS AND CHOICES

8.1 Account Information

You may review and update certain account information directly through the Platform's settings. For changes you cannot make yourself, you may contact us at support@jovialgaming.com.

8.2 Account Deletion

You may request deletion of your account by contacting us at support@jovialgaming.com. Upon account deletion, we will delete or anonymize your personal information as described in Section 6. Please note that deletion of your account will result in permanent loss of your competitive history, badges, rankings, and all other data associated with your account.

8.3 Location Data

You may disable location permissions for Jovial Gaming through your device settings at any time. Disabling location access may prevent you from being assigned to a Comp Ground or Zone and may limit your ability to use the Platform.

8.4 Push Notifications

You may opt out of push notifications by adjusting your device notification settings. Note that opting out of push notifications means you will not receive the Daily Brief or other time-sensitive platform notifications.

8.5 Advertising

You may limit interest-based advertising by adjusting your device's advertising settings or by opting out through applicable advertising network opt-out programs. Note that opting out does not mean you will see no ads, only that the ads you see will not be based on your interests as determined by tracking.

8.6 California Residents — CCPA Rights

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA):

  • The right to know what personal information we collect, use, disclose, and sell about you
  • The right to request deletion of your personal information
  • The right to opt out of the sale of your personal information (note: we do not sell personal information)
  • The right to non-discrimination for exercising your CCPA rights

To exercise your CCPA rights, please contact us at support@jovialgaming.com with the subject line "CCPA Request." We will respond to verified requests within 45 days as required by law.

8.7 Nevada Residents

Nevada residents may opt out of the sale of covered information by contacting us at support@jovialgaming.com. We do not sell personal information as defined under Nevada law.

9. COOKIES AND TRACKING TECHNOLOGIES

The Jovial Gaming mobile application may use the following tracking technologies:

  • Device identifiers and advertising IDs for analytics and advertising purposes
  • Local storage for app functionality and user preferences
  • Analytics SDKs to understand how users interact with the Platform
  • Advertising SDKs including Google AdMob for displaying advertisements

You may limit certain tracking through your device's privacy settings including resetting your advertising ID or limiting ad tracking.

10. THIRD-PARTY LINKS AND SERVICES

The Platform may contain links to third-party websites, services, or applications including social media platforms and third-party gaming platforms. This Privacy Policy does not apply to those third-party services. We encourage you to review the privacy policies of any third-party services you access through or in connection with Jovial Gaming.

Servizio is not responsible for the privacy practices or content of any third-party services.

11. ADVERTISING

Jovial Gaming displays advertisements served through Google AdMob and potentially other advertising networks. These networks may use device identifiers, IP addresses, and other information to serve advertisements that may be relevant to your interests.

Google's use of advertising identifiers is governed by Google's Privacy Policy, available at https://policies.google.com/privacy. You can opt out of personalized advertising from Google by visiting your Google account's ad settings or by adjusting your device's advertising settings.

Premium subscribers who have paid to remove advertisements will not be shown AdMob advertisements during their active subscription period.

12. INTERNATIONAL DATA TRANSFERS

Jovial Gaming is operated in the United States. If you are located outside the United States, please be aware that information we collect may be transferred to, stored, and processed in the United States where our servers are located and our central database is operated. By using the Platform, you consent to the transfer of your information to the United States.

During Season 0, the Platform is available only to users located within the United States.

13. AI-GENERATED CONTENT

Jovial Gaming uses artificial intelligence systems to generate editorial content including match recaps, zone activity summaries, and other platform content through Jovial Media features such as The Loop and Daily Wrap. These AI systems process competitive data including match results, rankings, and player activity to generate this content.

AI-generated content may reference your username and competitive statistics as part of platform editorial features. By using the Platform, you consent to your username and competitive data being used in AI-generated editorial content displayed on the Platform.

14. DATA COLLECTED FOR ANTI-ABUSE PURPOSES

To maintain the integrity of the Platform, Servizio collects and analyzes device fingerprints, IP addresses, account activity patterns, and other technical data to detect and prevent cheating, multi-account abuse, match farming, and other violations of our Terms of Use.

This data may be retained for a period beyond account termination to prevent banned users from creating new accounts and to protect the competitive integrity of the Platform. This retention is a legitimate interest of Servizio and is necessary for the operation of a fair competitive platform.

15. CHANGES TO THIS PRIVACY POLICY

Servizio reserves the right to update or modify this Privacy Policy at any time. When we make material changes, we will notify you by updating the effective date at the top of this policy and by providing notice through the Platform or via email to the address associated with your account.

Your continued use of the Platform following the posting of changes constitutes your acceptance of the updated Privacy Policy. If you do not agree to the updated Privacy Policy, you must stop using the Platform and delete your account.
